What is Medical Malpractice Insurance?
Medical Malpractice Insurance is a specialized form of Professional Indemnity coverage; designed to shield healthcare professionals from legal and financial exposure resulting from allegations of negligence, or errors in the delivery of care.
In Thailand, most Medical Malpractice policies follow a “claims-made” format. This means that the insurer agrees to “shall pay on behalf of the insured any loss arising from any claim for civil liability in respect of professional services, provided that such a claim is first made against the insured during the period of insurance.”
This structure ensures that, as long as a claim is submitted while the policy is active, the medical professional will be covered. However, it is important to note that coverage will not be provided if the incident is explicitly excluded under the policy, or if the claim stems from deliberate misconduct or fraud on the part of the medical professional.
